The terms that govern your use of the Trestle operating system — subscriptions, billing, data ownership, and what happens when you leave.

These Terms form the agreement between you (or the company you represent) and Trestle for using the Service. Plain language where we can; the governing law of the Republic of the Philippines is the final word.

01The agreement

These Terms of Service ('Terms') govern your access to and use of the Trestle operating system — the website, the product, the field app, and related services ('the Service'). By creating an account, subscribing, or using the Service, you agree to these Terms.

If you use the Service on behalf of a company, you represent that you are authorized to bind that company. The company agrees to these Terms through you.

02The Service

Trestle connects the parts of a construction business that usually run in separate places — estimating, budgeting, procurement, field, billing, and profit — into one operating system. From the first estimate to the final closeout, data is entered once and flows everywhere.

The Service is delivered as a subscription. It is a tool for running your business; it is not accounting, tax, or legal advice, and you remain responsible for the accuracy and completeness of your own records.

03Eligibility and accounts

You must be at least 18 years old to use the Service. You are responsible for the accuracy of your account information and for everything that happens under your account and the accounts of your authorized users.

You agree to keep your credentials confidential and to notify us promptly of any suspected unauthorized use of your account.

04Your responsibilities

You are responsible for the data your company enters into the Service, the permissions you grant to your users, and for complying with the law in how you use it — including the labor, tax, and data privacy obligations that apply to your employees, subcontractors, and suppliers.

You agree not to misuse the Service: no unauthorized access, no interference with other customers' data, no attempts to probe or bypass security, and no use that breaks the law.

05Fees, billing, and payment

Published prices are quoted in the currency we detect for your market — Philippine pesos (₱) in the Philippines, US dollars ($) elsewhere. You see the price applicable to your market at checkout.

Plans are billed in advance on the billing cycle you select. Fees are non-refundable except where required by law or stated in your agreement. If payment fails, we may suspend the account until it is settled.

Prices may change. We will notify you at least 30 days before a change affects your renewal. Taxes, where applicable, are added to the price.

06Trials and pilots

The Trestle pilot runs through 2026 in the Philippines. Founding members who join the waitlist keep their founding terms for as long as they stay.

Trial and pilot terms stated at sign-up prevail over these Terms where the two conflict.

07Your data and content

You own the data your company enters into the Service. We use it only to provide, operate, and improve the Service, and we process it under the Data Privacy Act of 2012 as described in the Privacy Policy.

You grant us a limited license to host, process, and store your data to provide the Service, including syncing it across your devices. This license ends when you delete the data or close the account.

08Export on exit

Your data leaves when you do. On cancellation, you can export everything in a bulk, machine-readable format at no charge, and we provide a reasonable transition period to download it.

After the transition period, we delete your data in line with our retention schedule. We compete on the product, not on the exit.

09Acceptable use

You agree not to:

  • use the Service for any unlawful, harmful, or infringing activity;
  • attempt to access another customer's account or data;
  • circumvent access controls, rate limits, or security measures;
  • scrape or mine the Service or its data at scale;
  • interfere with the availability or performance of the Service.

10Intellectual property

The Service, its design, and its code are owned by Trestle and its licensors. Nothing in these Terms grants you any rights to the Service beyond the subscription you hold.

Your data and your brand remain yours. We will not reuse your company name or marks as a reference customer without your permission.

11Offline-first and connectivity

The field app is designed to work offline and sync when a connection returns. You are responsible for maintaining your own backups of critical records where you judge them necessary, and for reviewing sync status after reconnecting.

Scheduled maintenance, connectivity failures, or interruptions on your side are not service outages under these Terms.

12Third-party services

The Service may integrate with third-party tools, payment processors, and hosting providers. Their terms and privacy policies apply to their part of the arrangement.

We are not responsible for third-party services, and we do not warrant their availability or performance.

13Disclaimers

The Service is provided 'as is' and 'as available'. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted or error-free. Trestle is a tool; your company remains responsible for the accuracy of its own records and the decisions it makes with them.

14Limitation of liability

To the maximum extent permitted by law, Trestle's total liability arising from or related to the Service will not exceed the fees you paid in the twelve months preceding the claim.

We are not liable for indirect, incidental, special, or consequential damages — including lost profits, loss of data, or business interruption — even if advised of the possibility. Nothing in these Terms limits liability that cannot be limited under applicable law.

15Indemnification

You will defend and indemnify Trestle and its officers, employees, and contractors against claims arising from your use of the Service, your data, or your breach of these Terms, to the extent the claim is caused by you.

16Suspension and termination

You may cancel your subscription at any time, effective at the end of the current billing period, and export your data as described above.

We may suspend or terminate access for breach of these Terms, for payment default, or where required by law, with notice where practicable. Sections that by their nature survive termination — export on exit, disclaimers, limitation of liability, indemnification, and governing law — remain in effect.

17Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines. The parties consent to the exclusive jurisdiction of the courts of the Philippines for any dispute arising from these Terms.

Disputes about personal data are also subject to the Data Privacy Act and the jurisdiction of the National Privacy Commission.

18Changes to these terms

We may update these Terms as the Service and the law evolve. Material changes will be posted with a revised effective date and, where we have your email, announced before they take effect.

Continued use after the effective date means you accept the new Terms. If you do not agree, you can cancel before the change takes effect.

These Terms work together with the Privacy Policy. Nothing in the Terms overrides a right you hold under the Data Privacy Act.
